Last updated: 25 August 2026
These Terms of Service ("Terms") govern your use of the PokeShop website at pokeshop.ie and any purchases made through the website.
Please read these Terms carefully before using our website or placing an order.
By using pokeshop.ie, you agree to these Terms. If you do not agree with these Terms, please do not use the website.
These Terms are subject to your statutory rights as a consumer under applicable Irish and European Union law. Nothing in these Terms is intended to limit or exclude any legal rights you may have.
1. About PokeShop
The website is operated by:
PokeShop
Offaly, Ireland
Email: pokeshopie@gmail.com

2. Using Our Website
You may use our website for lawful purposes only.
You agree not to:
-
Use the website for fraudulent or unlawful purposes
-
Attempt to gain unauthorised access to the website or its systems
-
Interfere with the operation or security of the website
-
Introduce malicious software or other harmful material
-
Use automated systems to access or scrape the website in a way that could damage or interfere with its operation
-
Misuse customer accounts or another person's information
We reserve the right to restrict or suspend access to the website where reasonably necessary to protect the website, our business or other users.
3. Customer Accounts
Some features of the website may allow you to create a customer account.
You are responsible for providing accurate information and keeping your account information up to date.
You are responsible for keeping your account login details confidential and should notify us if you believe that your account has been accessed without your permission.
We reserve the right to suspend or close an account where we reasonably believe that it has been used fraudulently, unlawfully or in breach of these Terms.
4. Products
We make reasonable efforts to ensure that product descriptions, photographs, prices and other information displayed on the website are accurate and up to date.
However, colours and appearance may vary depending on your device or screen.
We reserve the right to correct genuine errors in product descriptions, availability or pricing.
If a material error affects an order you have placed, we will contact you and give you the appropriate options under applicable consumer law.
5. Product Availability
All products are subject to availability.
Adding a product to your basket does not guarantee that the product will remain available until you complete your purchase.
If we are unable to fulfil an order because a product has become unavailable, we will contact you and, where appropriate, refund any payment made for the unavailable product.
6. Prices
All prices displayed on the website will be stated in euro (€) unless otherwise indicated.
The applicable price is the price displayed at the time you place your order, subject to any genuine pricing or technical error.
Where applicable, prices will include VAT and other taxes required by law.
Any applicable delivery charges will be displayed before you complete your purchase.
For deliveries outside Ireland, you may be responsible for customs duties, import taxes, VAT or other charges imposed by the destination country.
7. Placing an Order
When you place an order through our website, you are making an offer to purchase the products in your order.
After placing an order, you should receive an order confirmation by email.
An order confirmation acknowledges that we have received your order. It does not necessarily mean that the order has been accepted where, for example, there is a genuine pricing error, a product is unavailable, or we are unable to fulfil the order.
We will normally accept your order when we dispatch the products to you or otherwise confirm that the order has been accepted.
If we cannot accept your order, we will inform you and refund any payment that has already been taken.
8. Payment
Payment must be made using the payment methods available at checkout.
Payments are processed using payment services available through our website and Wix.
We do not intentionally store your complete payment card details on our own systems.
Your payment provider may have its own terms and privacy policies.
9. Delivery
We currently ship orders using postal and delivery services, including An Post.
We will send your order to the delivery address provided during checkout.
You are responsible for ensuring that the delivery address you provide is accurate and complete.
We will make reasonable efforts to dispatch orders within the timeframe stated on the website or at checkout.
Delivery times may vary depending on destination, postal services, customs procedures and circumstances outside our reasonable control.
If your order is delayed or does not arrive, please contact us at:
Under Irish consumer law, goods must generally be delivered by the agreed delivery date or, where no specific date has been agreed, within 30 days unless another arrangement applies.
Nothing in these Terms limits your statutory rights regarding delayed or non-delivered goods.
10. International Orders
We accept orders for delivery outside Ireland, including to countries within the European Union and the United Kingdom.
International deliveries may be subject to customs requirements, import duties, taxes or other charges imposed by the destination country.
Unless otherwise stated at checkout, such charges are the responsibility of the customer.
Customers are responsible for ensuring that the products they order may legally be imported into their destination country.
Delivery times for international orders may be affected by customs processing and other circumstances outside our control.
11. Your Right to Cancel an Online Order
If you are a consumer purchasing goods online, you generally have a statutory right to cancel your purchase within 14 days of receiving the goods, without giving a reason.
This is commonly known as the cooling-off or withdrawal period.
If your order consists of multiple goods delivered separately, the cancellation period generally begins when you receive the last of those goods.
To exercise your right to cancel, you should contact us clearly within the applicable cancellation period.
You can contact us at:
You may simply tell us that you wish to cancel your order. You do not have to provide a reason.
After notifying us, you generally have a further 14 days to return the goods.
12. Returns
If you exercise your statutory right to cancel, you must return the goods to us within 14 days after notifying us of your cancellation.
Unless otherwise required by law, you are responsible for the direct cost of returning goods when exercising the statutory cancellation right.
Goods should be returned safely and securely packaged.
You may handle and inspect goods to the extent reasonably necessary to establish their nature, characteristics and functioning. However, you may be responsible for any reduction in value resulting from handling beyond what is reasonably necessary for inspection.
Nothing in this section affects your statutory rights regarding faulty, defective or misdescribed goods.
13. Refunds
Where you validly exercise your statutory right to cancel, we will refund the relevant payment in accordance with applicable law.
Refunds will generally be made using the same payment method used for the original transaction, unless another method has been agreed.
We may withhold reimbursement until we have received the returned goods or you have provided evidence that they have been returned, whichever occurs first, where permitted by law.
Where required by law, we will reimburse the applicable standard delivery charge paid for the original delivery.
Additional costs resulting from choosing a more expensive delivery option than our standard delivery option may not be refundable.
We will process refunds within the timeframe required by applicable consumer law.
14. Exceptions to the Right to Cancel
The statutory right to cancel does not apply in every circumstance.
Certain products may be excluded from the statutory cancellation right where an applicable legal exemption exists, including certain personalised or made-to-order products and certain goods that cannot be returned for health or hygiene reasons once unsealed.
Where a legal exception applies, we will provide the relevant information before purchase.
These exceptions do not remove your legal rights where goods are faulty, defective or not as described.
15. Faulty, Damaged or Incorrect Products
We want you to receive your order in the condition and specification you purchased.
If you receive a product that is:
-
Faulty or defective
-
Damaged
-
Not as described
-
The wrong product
-
Missing from your order
please contact us as soon as reasonably possible at:
Please include your order number and, where useful, photographs or other information that helps us understand the problem.
Your statutory consumer rights apply to faulty, defective or misdescribed goods.
Depending on the circumstances and applicable law, you may have rights to a repair, replacement, price reduction, refund or termination of the contract.
Nothing in these Terms limits or excludes those statutory rights.
16. Damaged Packages
If your order appears to have been damaged during delivery, please contact us as soon as reasonably possible.
Where appropriate, we may ask you to provide photographs of the packaging and the product so that we can investigate the issue with the delivery service.
Your statutory rights are not affected by this process.
17. Order Cancellation by PokeShop
We may cancel an order in circumstances where we are unable to fulfil it, including where:
-
A product is unexpectedly unavailable
-
There is a genuine and obvious pricing or listing error
-
We reasonably suspect fraudulent or unlawful activity
-
We are unable to deliver to the specified destination
-
Circumstances outside our reasonable control prevent fulfilment
If we cancel an order after payment has been taken, we will refund the amount paid for the affected order or product, as applicable.
18. Intellectual Property
Unless otherwise stated, the content of pokeshop.ie, including text, photographs, graphics, logos, product descriptions, designs and other materials, is owned by or licensed to PokeShop.

19. Website Availability
We aim to keep pokeshop.ie available and functioning correctly, but we do not guarantee that the website will always be available, uninterrupted or error-free.
The website may occasionally be unavailable because of maintenance, updates, technical problems or circumstances outside our reasonable control.
20. Third-Party Services
Our website relies on third-party services, including Wix, payment providers and delivery services.
Those services may have their own terms and conditions and privacy policies.
We are not responsible for failures of third-party services that are outside our reasonable control, although this does not affect your statutory consumer rights.
21. Privacy
Our collection and use of personal data is explained in our Privacy Policy.
By using our website, you acknowledge that your personal data may be processed in accordance with our Privacy Policy.
22. Limitation of Liability
Nothing in these Terms excludes or limits liability where doing so would be unlawful.
In particular, nothing in these Terms affects your statutory consumer rights or any liability that cannot legally be excluded or limited.
Subject to the above, we are not responsible for losses that are not reasonably foreseeable or that arise from circumstances outside our reasonable control.
23. Events Outside Our Reasonable Control
We will not be responsible for delays or failures caused by circumstances outside our reasonable control, including significant postal or delivery disruptions, natural disasters, severe weather, war, civil unrest, government action, strikes, widespread technical failures or other events beyond our reasonable control.
Where such an event affects an order, we will make reasonable efforts to keep you informed and fulfil the order as soon as reasonably possible.
Your statutory rights remain unaffected.
24. Governing Law
These Terms are governed by the laws of Ireland.
If you are a consumer living in another EU member state, you may also have mandatory consumer protection rights under the laws of your country of residence that cannot be excluded by these Terms.
Nothing in these Terms prevents you from exercising any mandatory rights available to you under applicable consumer protection law.
